Sheri L. Gordon
Sheri Gordon is widely respected for her thorough approach to complex patent disputes and high-stakes IP litigation.
Sheri Gordon is a critical member of the Nixon Vanderhye litigation team, focusing on major trials, appeals, and USPTO post-patent issuance proceedings in which patent validity is challenged.
Her insights on important issues assist clients with securing their IP from infringement and validity challenges, as well as defending against IP enforcement claims by others.
Notably, Sheri was part of the Nixon Vanderhye team that secured a jury verdict in a Walker Process fraud/sham patent litigation antitrust case and an award in excess of $115 million in actual damages following 12 days of trial. This was one of the largest Walker Process/sham patent litigation awards on record.
She was also part of the Nixon Vanderhye team that obtained summary judgment of non-infringement on behalf of Yamaha in Pazandeh v. Yamaha, and successfully defended that judgment on appeal to the Federal Circuit.
In addition to litigation and related matters, Sheri assists clients with freedom to operate, due diligence, litigation clearance, and licensing matters, and periodically becomes involved in discrete patent prosecution matters such as ex parte appeals to the USPTO’s Patent Trial and Appeal Board.
Sheri knew from an early age that she wanted to be a trial attorney. She began her legal career while in law school, clerking for general trial attorneys on civil and criminal matters. She was exposed to IP law immediately after law school while working at an IP boutique, and made the decision to focus her practice on IP litigation. Before joining Nixon Vanderhye, Sheri was a consultant with the Ethics Resource Center where she focused on both business and legal ethics matters, and contributed to a number of ethics articles published in The Federal Lawyer and various trade publications.
Experience
- Represented TouchTunes Music Corp. in federal litigation involving digital jukebox technology to obtain summary judgment in favor of TouchTunes.
- Obtained summary judgment of non-infringement on behalf of Yamaha in Pazandeh v. Yamaha, and successfully defended the judgment on appeal to the Federal Circuit.
- Represented ShuffleTech, Inc. in federal antitrust litigation involving automatic card shufflers to obtain a favorable jury verdict and subsequent settlement in excess of $150 million.
