The viability of the European Union’s unitary patent system, and particularly the integral Unified Patent Court (UPC), has been called into question after the United Kingdom withdrew from the UPC in February as part of its ongoing Brexit strategy and Germany’s Second Senate of the Federal Constitutional Court held in an order published today (Press Release No. 20/2020) that Germany’s plan to ratify the UPC Agreement was not constitutional.
